1. Acceptance of Terms

By accessing and using TinyBrain's services available at tinybrain.app ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

TinyBrain provides an AI gateway platform that optimizes API requests to large language models (LLMs) through intelligent routing, prompt compression, and output optimization. The Service acts as an intermediary between your applications and AI providers such as OpenAI, helping you reduce costs while maintaining quality.

3. User Accounts

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept all responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

4. API Keys and Third-Party Services

You are responsible for providing and managing your own API keys for third-party AI providers. You agree that:

• You have the legal right to use the API keys you provide
• You are responsible for all costs associated with your API usage
• TinyBrain encrypts and stores your API keys securely but is not responsible for unauthorized access resulting from your own security breaches
• You must comply with all third-party provider terms of service
• TinyBrain is not liable for service interruptions from third-party providers

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any proprietary notices

6. Service Fees and Payment

TinyBrain may charge fees for certain features of the Service. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees at any time with reasonable notice. You are responsible for all charges incurred under your account, including charges from third-party AI providers resulting from requests made through our Service.

7. Intellectual Property Rights

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of TinyBrain and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data as described in our Privacy Policy. By using the Service, you consent to such processing and you warrant that all data provided by you is accurate.

9. Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be available at all times or that it will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, TinyBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

You agree to defend, indemnify, and hold harmless TinyBrain and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
